1. Acceptance of Terms

By accessing or using Sosiev ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Sosiev is an AI-powered platform for creating and managing consistent virtual character personas. The Service includes character definition, image generation, video generation, talking head creation, and content export features.

3. User Accounts

3.1 Registration

You must register for an account to use the Service. You must provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.

3.2 Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older.

4. Subscription & Payments

4.1 Pricing

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually as selected at checkout. Prices are subject to change with notice.

4.2 Billing

Subscriptions automatically renew unless canceled before the renewal date. You authorize us to charge your payment method on file for renewal fees.

4.3 Refunds

Due to the nature of AI-generated content, all sales are final. We do not offer refunds for partial months or unused generation credits. If you experience technical issues that prevent you from using the Service, contact support within 7 days.

5. Acceptable Use

You agree NOT to use the Service to:

  • Create content depicting real individuals without their consent
  • Generate illegal, harmful, or explicit content involving minors
  • Create deepfakes or content intended to deceive
  • Generate content that infringes third-party intellectual property
  • Engage in harassment, discrimination, or hate speech
  • Attempt to bypass content moderation or safety filters
  • Use automated tools to scrape or bulk-download content
  • Resell, sublicense, or commercially redistribute the Service without authorization

6. Content Ownership

6.1 Your Content

You retain ownership of the Character Definition Language (CDL) specifications you create. Subject to these Terms, you own the generated images, videos, and other output created through the Service for your personal or commercial use.

6.2 License to Us

You grant us a non-exclusive, worldwide, royalty-free license to host, display, and process your content as necessary to provide the Service. This license ends when you delete your content or account.

6.3 AI-Generated Content

Generated content is produced by third-party AI models. We make no guarantees about the uniqueness, accuracy, or suitability of generated content for any particular purpose.

7. API Usage

Business tier users may access our API. API access is subject to rate limits and fair use policies. Abuse of the API may result in immediate termination.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOSIEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Sosiev and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason with notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.
